45 Mr. Rabbitte asked the Minister for Public Enterprise if Dúchas has awarded the necessary licence to Luas in respect of the laying of tracks across the archaeological site at Kingswood; and if she will make a statement on the matter. [12190/02]

The Railway Procurement Agency, which has responsibility for the Luas works, does not require a licence in respect of the laying of tracks across the archaeological site at Kingswood. I understand the agency has agreed to carry out appropriate mitigation work at the site. Dúchas has issued archaeological excavation licences to permit the mitigation to be carried out and has agreed to the laying of the tracks. The agency has assured me that it is liaising with Dúchas on an ongoing basis in relation to Luas works carried out in this area.
