Question:

80 Mr. Ring asked the Minister for Agriculture, Food and Rural Development the reason a person (details supplied) in County Mayo did not receive headage or area based payments for 2000 and 2001. [12313/02]

The 2000 area aid application of the person named was fully processed with an area determined for payment purposes of 112.2 hectares. The father of the person named who was the registered owner of the property in this case died intestate in 1997 and the herd number was transferred to the person named. In May 2000, the person named died without making a will. Contact was made with Castlebar DVO to have the herd number changed and as a result of investigations it came to light that there was a family dispute ongoing. The matter was further investigated by the DLO and it transpired that some payable orders which had issued to the deceased had been cashed. It was ascertained that these had been cashed to cover funeral expenses. Administration has now been granted by the High Court to the mother of the person named.

The issuing of the outstanding payable order in respect of the 2000 ewe premium scheme, final instalment, is being arranged. No area aid application was received in the Department for 2001 under the herd number of either the person named or the person to whom his herd number was transferred upon his death. Therefore, no area based payments could be made for 2001.

81 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive area based payments for 2001. [12314/02]

One of the parcels claimed by the person named in his 2001 area aid application was also claimed by another herdowner. The area aid unit has examined the files of both herdowners involved and has resolved the matter in favour of the person named. The 2001 area aid application for the person named has now been fully processed with an area determined for payment purposes of 27.37 hectares. Payment due under the 2001 area based compensatory allowance scheme will issue shortly.
