136 Mr. Wall asked the Minister for the Environment and Local Government the plans his Department has to change the position of vesting of local authority housing where the husband has left the family home, but the house is vested in his name and he will not agree to transfer the ownership to his wife in view of the fact that he has left for more than nine years; and if he will make a statement on the matter. [14180/02]

The operation of vesting procedures in relation to purchase of local authority housing is the responsibility of the housing authority concerned. My Department would not be involved in this process.

Once ownership of a house has been transferred from a housing authority issues relating to further transfer of ownership would not be dealt with under housing legislation. It would come under the regime for conveyance of real property. It might be appropriate, in the circumstances outlined in the Deputy's question, for affected parties to take legal advice.
