275 Mr. Durkan asked the Minister for the Environment and Local Government if he will confirm the existence of a valid CPO order at the time of the land acquisition at the M9 Kilcullen motorway link by Kildare County Council acting as agents for his Department; and if he will make a statement on the matter. Kildare County Council submitted the Kilcullen link motorway scheme, 1987 and accompanying environmental impact statement to the then Minister for the Environment on 1 December 1987. A public local inquiry into the proposed scheme was held from 10 to 12 May 1988.

Two orders were signed by the Minister on 26 May 1989 – an Order approving the motorway scheme with modifications and an order declaring the proposed public road, as indicated on the map attached to the order, to be a motorway. Public notice of the Minister's decision was given by Kildare County Council on 28 June 1989. The Minister's approval of the motorway scheme gave the council the legal right to compulsorily acquire the land required for the scheme. The motorway was subsequently constructed under the supervision of Kildare County Council and opened to traffic in October 1994.
