Question:

293 Mr. O'Shea asked the Minister for Social and Family Affairs if, further to Parliamentary Question No. 142 of 20 June 2002, she will indicate the date of the specialist medical examination for the person in question; and if she will make a statement on the matter. [15079/02]

Arising from evidence presented at an oral hearing of the person's appeal against a decision disallowing her entitlement to disability benefit, the appeals officer requested that a special medical examination be undertaken.

It is now proposed to hold this examination in the week commencing 15 July 2002. The person concerned will be advised of the arrangements when these have been completed.

Under social welfare legislation decisions in relation to claims must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
