65 Mr. Ring asked the Minister for Agriculture and Food when a person (details supplied) in County Mayo will be paid an area based payment for 2002. [17835/02]

The 2002 area aid application of the person named has been fully processed with a forage area determined for payment purposes of 528.46 hectares. The person named will be paid his full entitlement under the 2002 area based compensatory allowance scheme within the next two weeks.

66 Mr. Ring asked the Minister for Agriculture and Food when a person (details supplied) in County Mayo will receive an area based payment for 2002. [17836/02]

The person named included four parcels of land on his 2002 area aid application that relate to commonages in respect of which he has failed to furnish proof of his entitlement to claim area aid. In addition, in the case of two of the commonages, overclaims have been determined. The herdowner has been written to in order to clarify the matter and a response is awaited.

Until this matter is resolved the area aid application for the person named cannot be fully processed and no area related payments can issue.

67 Mr. Ring asked the Minister for Agriculture and Food when a person (details supplied) in County Mayo will receive an area based payment for 2002. [17837/02]

The 2002 area aid application of the person named has been fully processed with a forage area determined for payment purposes of 88.11 hectares.

The animal based headage schemes were replaced in 2001 by the area-based compensatory allowance scheme. The area-based scheme, which was approved by the European Commission, provides that applicants must meet a minimum stocking level of 0.15 livestock units per forage hectare of the holding in the year preceding application. However, farmers who are unable to meet that minimum stocking density but who traditionally qualified for headage grants in respect of cattle and sheep may qualify for payment under the area-based scheme, provided their land is being utilised and is not in danger of undergrazing.

The person named was not a headage recipient in 2000, but according to my Departments records, the stocking density of the holding does not meet the minimum stocking density. My Department will be in contact with the person named shortly with a view to establishing the type of farming activity being pursued. A decision on entitlement to 2002 area-based compensatory allowance will then be made.

The person named has applied for area aid in 2002 in respect of a plot of land which is overlapping with a commonage parcel . The herdowner has not furnished proof of his entitlement to claim area aid in respect of this commonage. My Department has been in contact with him to clarify the position and a response is awaited.

Until this matter is resolved, the area aid application for the person named cannot be fully processed and no area related payments can issue.
