Question:

413 Mr. Ring asked the Minister for Social and Family Affairs the outcome of a pension appeal by a person (details supplied) in County Mayo, following an oral hearing on 10 October 2002. [18837/02]

The person concerned, who is in receipt of a pre-retirement allowance, was disallowed payment in respect of the period 17 January 2002 to 10 March 2002 as he was resident outside the State during that time. He appealed against this decision to the social welfare appeals office. An oral hearing of his appeal was held on 10 October 2002, following which the appeals officer, having examined all the evidence in the case, disallowed the appeal. Notification of the decision has issued to the person concerned. Under social welfare legislation decisions in relation to claims must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
