Question:

105 Mr. Stanton asked the Tánaiste and Minister for Enterprise, Trade and Employment the action she has taken or intends to take to implement the Directive on the Harmonisation of Certain Aspects of Copyright and Related Rights in the Information Society; if legislation is required; if so, the details of same; the timetable for same; and if she will make a statement on the matter. The principal objective of this directive was the incorporation into law of the provisions of the 1996 World Intellectual Property Organisation copyright treaty and the performances and phonograms treaty. As the provisions of the WIPO treaties were given effect in Irish law through the Copyright and Related Rights Act, 2000, we are already in substantial compliance with the directive. The manner of transposition of outstanding requirements of the directive is currently under examination by my Department, in consultation with the Office of the Attorney General. While legislation will be required, the question as to whether implementation of the directive may be effected by regulation rather than primary legislation is still under consideration.
