Vol. 557 No. 6

Written Answers. - Registration of Title.

Michael Ring

Question:

208 Mr. Ring asked the Minister for Justice, Equality and Law Reform when a section 49 application will be completed for persons (details supplied) in County Mayo. [23077/02]

I am informed by the Registrar of Titles that this is an application under section 49, i.e. acquisition of title by virtue of long possession, of the Registration of Titles Act, 1964, which was lodged on 4 October 2001. Dealing number D2001SM007530R refers.

I understand that due to their complicated nature, applications under section 49, which require detailed examination of claims for registration as owners, can take some time to process.

I am further informed that queries which issued to the lodging solicitor have now been replied to. I am also informed that notices of the application were served on parties with a possible interest in the property on 8 July 2002, that an objection to the registration of the applicants was received on 4 September 2002 and that this objection is being dealt with.

I can assure the Deputy that the application is receiving attention in the Land Registry and that when this objection to the registration of the applicants and any other queries in relation to the application have been satisfactorily dealt with the matter will be brought to a conclusion as quickly as possible.
