156 Mr. Cuffe asked the Minister for Transport his plans to make it mandatory for a claimant for compensation in relation to the Roads Act, 1993, to provide proper title to the land concerned before a claim for compensation be processed. [23908/02]

The compensation code for the compulsory purchase of land for the purposes of the Roads Act, 1993 provides for the payment of compensation by road authorities for lands acquired by them. The amount of compensation payable is a matter for negotiation between the land owner and the road authority concerned, or in the event of dispute, for arbitration.

Owners are required to furnish to the local authority satisfactory title to the property being acquired. There are no proposals to introduce a mandatory requirement as suggested by the Deputy.
