45 Mr. Kenny asked the Minister for the Environment and Local Government the number of files which his Department has submitted to the Flood tribunal; and if he will make a statement on the matter. [22285/02]

53 Mr. Kenny asked the Minister for the Environment and Local Government the nature of the files which have been submitted to the Flood tribunal by his Department; and if he will make a statement on the matter. [22286/02]

I propose to take Questions Nos. 45 and 53 together.

The Flood tribunal, which is inquiring into certain planning matters and payments, is empowered by relevant Oireachtas resolutions to carry out such preliminary investigations in private as it thinks fit. My Department has co-operated with all requests by the tribunal to make files available. It would not be appropriate, however, to disclose details of material provided in this way to the tribunal, on a strictly private and confidential basis, in the course of its investigations.
