I propose to take Questions Nos. 67, 168, 172, 173 and 194 together.
Under the habitats directive, 364 candidate special areas of conservation – cSACs – have been publicly notified and formally transmitted by Ireland to the European Commission. In addition, a total of 110 special protection areas – SPAs – have been designated under the birds directive in Ireland. SPAs and cSACs are collectively known as Natura 2000 sites and will form part of a network of protected natural areas throughout the European Union. A list of these Natura 2000 sites is in table 1.
In March 2002, Dúchas the heritage service of my Department publicly advertised and notified known landowners of intention to designate 25 further SPAs and nine extensions to existing sites; these sites are listed in table 2. Some further SPAs will be proposed in 2003, when boundary surveys have been completed. I should stress that the protective mechanisms in respect of Natura 2000 sites are effective from date of initial notification of these sites. The legal provisions are set out in the European Communities (Natural Habitats) Regulations, 1997, as amended by section 75 of the Wildlife (Amendment) Act, 2000. In addition, the EU Commission is now seeking to finalise a list of cSACs, except for offshore sites, for the Atlantic region of Europe, in the first half of 2003.
Preparations are well advanced to complete Ireland's list of cSACs, following the evaluation of the existing list, along with those of other member states in the Atlantic region, at a meeting in The Hague last June. I intend to publish further proposals in this regard in December 2002 and January 2003. There will be a particular focus on rivers, to support the conservation of salmon and other aquatic species, and on raised bogs, fens and other wetland habitats. Under the terms of the habitats directive, formal designation of special areas of conservation must take place as soon as possible after the adoption of the list at European level, and within six years at most.
There is no set timetable for designation of natural heritage areas, NHAs, under the Wildlife (Amendment) Act, 2000. I intend to publish proposals in December for designation of raised bogs as NHAs. Designation of other NHAs meeting appropriate scientific criteria as sites of ecological or geological interest, or both, will proceed from 2003 onwards, as rapidly as resources permit.
The birds directive has been implemented in Ireland since 1985, many of its requirements being met by the pre-existing provisions of the Wildlife Act, 1976. A primary requirement of the directive, and the clearest indicator of progress in its implementation, is the designation of special protection areas, as already described. The directive also requires member states to take measures to maintain populations of all species of wild birds, and their habitats. Recurring surveys of wild birds and their distribution, such as the Irish wetland birds survey and the countryside birds survey are keys to determining priorities in this regard. Such surveys are carried out in partnership with Birdwatch Ireland, with funding from my Department and other sources. The European Court of Justice decided last June that Ireland had failed to fulfil, by June 1998, one of its obligations under the directive, with regard principally to habitats of red grouse. The programme of reduction in sheep stocking levels on commonages, commenced in 1998, is the primary measure to remedy the problem identified by the court judgment.
