Question:

245 Mr. Ferris asked the Minister for Agriculture and Food the details of the information sent by his Department to the Ombudsman regarding a representation made by a person (details supplied) in County Kerry. [1656/03]

My Department provided the Office of the Ombudsman with copies of all the records it held in relation to the application for early retirement pension by the person named.

The person named had also sought these records under the Freedom of Information Act, 1997. These records were released to him with the exception of correspondence between the Department, its legal advisers and the Office of the Ombudsman. These records are exempt under sections 22(1)(a) and 46(1)(c)(iii) respectively of the Freedom of Information Act.
