Question:

757 Mr. Durkan asked the Minister for Transport if a driving license endorsement is carried forward to a person's new licence ten years later (details supplied) in County Kildare; and if he will make a statement on the matter. [27140/02]

Section 37(2) of the Road Traffic Act 1961, as amended by section 49(1)(e) of the Road Traffic Act 1994, provides that persons convicted of certain offences must carry notice of their conviction(s) on their driving licences by way of endorsement for a minimum period of three years. The Act further provides that where a convicted person is not the holder of a current licence at the time of a conviction, the details of such conviction must be endorsed on the next licence granted to that person.

The person concerned first held a provisional driving licence valid for the period 9 December 2002 to 8 December 2004. Notice of the conviction is endorsed on this licence and will have to be carried on any further licences until the endorsement is carried on a valid licence for three years.
