Question:

829 Mr. McGuinness asked the Minister for Justice, Equality and Law Reform if an appeal in the name of a person (details supplied) will be expedited; and if his Department will acknowledge the appeal documents lodged on 11 October 2002. [1370/03]

This appeal is to the Refugee Appeals Tribunal arising from an earlier recommendation of the Office of the Refugee Applications Commissioner in relation to the applicant's asylum application. The Office of the Refugee Applications Commissioner considers applications for a declaration as a refugee at first instance and the Refugee Appeals Tribunal considers applications for a declaration at appeal stage. Both offices were established under the Refugee Act 1996 to make recommendations to the Minister for Justice, Equality and Law Reform on whether such status should be granted. Both offices are statutorily independent in their functions and it would not be appropriate for me to comment on this case.
