Question:

853 Mr. Quinn asked the Minister for Justice, Equality and Law Reform the reasons for refusing a holiday visa for a person (details supplied) in County Kilkenny to visit their spouse (details supplied) since September 2001; the rules and regulations for a spouse of a non EU national who is employed in the healthcare service to visit on holiday or to remain permanently in Ireland; and if he will make a statement on the matter. [1777/03]

The visa application in question was refused due to insufficient supporting documentation. Additional documentation was subsequently submitted in connection with an appeal against the refusal. The application was approved on appeal on 24 January 2003. The following is the position in respect of non-EEA nationals who are legally employed in the State and who wish to be joined here by visa required family members. The worker in question must have been in the State for a period of 12 months, with the exception of persons employed in a limited number of high skill areas where this period is reduced to three months, and have the expectation of remaining here for at least a further 12 month period before he or she can be joined here.
