Question:

863 Mr. Naughten asked the Minister for the Environment and Local Government if he will review the legislation covering the erection and removal of telegraph poles; and if he will make a statement on the matter. [1479/03]

Section 254 of the Planning and Development Act 2000, as amended by section 54 of the Communications Regulation Act 2002, provides that a licence is required from the relevant local authority for the erection of overground electronic communications infrastructure along a public road.

The provision of a telegraph pole, other than along a public road, would be subject to the planning code. The planning and development regulations 2001 provide that the erection of telegraph poles by a statutuory undertaker is exempted development subject to certain conditions and limitations including restrictions on the height and diameter of the poles. As the legislation has been so recently revised, I have no proposals for a further review at this stage.
