194 Mr. Cregan asked the Tánaiste and Minister for Enterprise, Trade and Employment in view of the fact that Ireland has one of the lowest installations of ATMs in Europe, the position regarding the confusion between the Department of Enterprise, Trade and Employment and the Department of Finance and agencies under their control; the plans to authorise-licence companies wishing to install private ATMs or to issue a clean set of instructions and directions as to what requirements they must fulfil and that these directions be not contradictory as between Department agencies. [1949/03]

I share the Deputy's concern regarding the low level of automated teller machines, ATMs, in this country and I would urge the banking industry and prospective ATM operators to provide consumers with the maximum levels of ATM service possible.

I am not aware of any confusion which may exist between my Department and the Department of Finance in relation to the installation of ATMs in this country. As there is no requirement that companies installing or operating ATMs be licensed or authorised it is difficult to see where such confusion would arise. Companies are free to engage in the installation of ATMs as they wish.

Under the Consumer Credit Act 1995, approval of any charges which may be applied by credit institutions or credit institutions sponsoring independent ATM operators is a matter for the Director of Consumer Affairs, who is independent in her functions.

I have no plans, therefore, to introduce any legislation in relation to the provision of authorisations or licences for companies or persons who wish to install ATM facilities.
