207 Dr. Upton asked the Minister for Agriculture and Food the reason a person (details supplied) in County Cork was refused additional milk quota under the scheme for the allocation of milk quota. [27039/02]

The allocation of the balance of the Agenda 2000 milk quota to certain categories of small and medium scale milk producers has now been completed and applicants have been notified of the outcome in their own cases.

The person named submitted an application under the farm modernisation scheme category. Unfortunately, on the basis of the information supplied the applicant did not satisfy the conditions of the scheme and an allocation was not made. Notification to that effect has been sent to the applicant.

An appeals procedure exists in relation to this scheme and the person named has now submitted an appeal. The assessment of appeals will be based on recommendations from the milk quota appeals tribunal. When the appeals process is completed each appellant will be notified of the outcome of his or her case.

208 Dr. Upton asked the Minister for Agriculture and Food the conditions which a person must satisfy to qualify under the scheme for the allocation of milk quota under the 32 million litres scheme. [27040/02]

I introduced the 32 million litres scheme in order to make specific provision for milk producers whose initial quota allocations were low as a result of certain circumstances. In that regard, I decided that producers who had been following dairying development plans under the farm modernisation scheme and the reduced interest subsidy scheme for farmers in financial difficulty at the time of the introduction of the milk quota regime would benefit under this scheme. Furthermore, producers whose milk deliveries during 1983, the quota year, were adversely affected by an outbreak of animal disease in their herd in the period 1978 to 1980, were also eligible to apply.

In setting down the criteria for eligibility in the allocation of the 32 million litres, I adhered to the objectives of providing additional quota to active producers in the small and medium size category who had demonstrated their commitment to milk production. These are the broad criteria which I have used in allocating all of the additional quota available to Ireland under agenda 2000.

The conditions of the scheme are set down in Public Notice 94/15.
