Question:

356 Mr. P. Breen asked the Minister for Transport his views on whether, unlike the situation pertaining to special areas of conservation, the absence of both a prior consultation process and subsequent compensatory measures pertaining to red safety areas in the vicinity of Irish airports is contrary to natural justice and also repugnant both to the constitutional rights of land ownership as enshrined in the Constitution of Ireland and Article 1 of the First Protocol - Protection of Property - of the European Convention of Human Rights; and if he will make a statement on the matter. [2603/03]

The Deputy may be aware that the type of issues raised in his question are the subject of a High Court case in which my Department was involved, and that the judgment on that case was issued this morning.

I will not be in a position to comment on this matter until I have had time to study the judgment of the court.

Question:

357 Mr. P. Breen asked the Minister for Transport if either FLS Aerospace or the Irish Kennel Club buildings are situated within red safety areas near Dublin Airport; if so, the percentage of the total area; and if he will make a statement on the matter. [2604/03]

The matter of developments in the "red zone" of Dublin airport was covered extensively in answer to Parliamentary Questions Nos. 99, 100, 108 and 109 on 4 July 2001. As indicated in that reply, Aer Rianta or the Fingal planning authority will be in a position to provide the Deputy with any further information he may require in relation to specific premises.

358 Mr. P. Breen asked the Minister for Transport if Irish Aviation Authority approval or planning permission was sought and obtained in respect of the high-level floodlights surrounding the all weather pitch in the ALSAA complex under the approach path of runway 10/28 at Dublin Airport; and if he will make a statement on the matter. [2605/03]

The issues which the Deputy has raised are matters for Aer Rianta and the planning authorities, and are not matters in which I have a function.

359 Mr. P. Breen asked the Minister for Transport if aircraft below 450 metres above ground level over assemblies of people are in contravention of Rule 3 of the current Irish Aviation Authority (Rules of the Air) Order (SI 568 of 2001) on either approach or departure to any runway at any of the State airports; and if he will make a statement on the matter. [2606/03]

The issue which the Deputy has raised falls within the remit of the Irish Aviation Authority.
