409 Mr. Allen asked the Minister for the Environment and Local Government if he has received a final written warning from the EU regarding inadequate waste legislation; and the nature of the final written warning. [2541/03]

Question:

410 Mr. Allen asked the Minister for the Environment and Local Government if the Government will be given a final written warning for failing to comply with certain provisions of the packaging waste directive and due to shortcomings in legislation implementing EU legislation on packaging waste. [2542/03]

I propose to take Questions Nos. 409 and 410 together.

The European Commission has recently addressed three Reasoned Opinions, final written warnings, to Ireland under Article 226 of the treaty in relation to the transposition and implementation of specific EU waste directives, as follows: (1) alleged failure to adopt the laws, regulations and administrative provisions necessary to comply with European Parliament and Council Directive 2000/53/EC on end-of-life vehicles – ELVs. Draft legislation is being developed to support implementation of an appropriate ELV recovery scheme in line with the requirements of the Directive. I refer to the reply to Question No. 117 of today's date; (2) alleged failure correctly to apply a number of provisions of Council Directive 75/442/EEC on waste in relation to unauthorised waste operations within or close to the Boyne Estuary Special Protection Area. A response to the European Commission is being prepared on the matter; (3) alleged failure to bring into force and notify the European Commission of measures necessary to fulfil the packaging waste recovery and recycling targets required to be achieved by Ireland by 31 December 2005 under Article 6 of European Parliament and Council Directive 94/62/EC on packaging and packaging waste. In accordance with the notification procedure provided for in Article 16 of the directive, draft regulations intended to facilitate the achievement of the specified targets were notified to the Commission on 22 October 2002.
