478 Mr. Naughten asked the Minister for Justice, Equality and Law Reform the legislation covering the unauthorised video recording of children and storage of such material, other than on security cameras; if he intends to review the legislation; and if he will make a statement on the matter. [3769/03]

The only criminal legislation under the aegis of my Department that could govern the video recording of children is the Child Trafficking and Pornography Act 1998. For an offence to be committed under the child pornography provisions of that Act any image taken of children must constitute child pornography or be used for the purpose of creating child pornography. In the absence of any such criminality an offence could not be committed under the criminal law in the circumstances outlined in the Deputy's question.

I will continue to keep the law in this area under review but I have no immediate plans for legislative changes.
