Question:

180 Mr. R. Bruton asked the Tánaiste and Minister for Enterprise, Trade and Employment if the Government has considered the possibility of reintroducing malicious injury damage to cover instances such as when an uninsured driver inflicts property damage on a householder; and if she will make a statement on the matter. [4087/03]

The matter raised by the Deputy is not one that comes within my area of responsibility.

The legal requirement for motorists to have third-party insurance cover arises out of the provisions of the Road Traffic Acts and these come within the responsibility of the Minister for Transport. An agreement drawn up between the Motor Insurers' Bureau of Ireland and the Minister for the Environment provides for compensation arrangements for innocent victims of uninsured drivers. The relevant section of that Department now forms part of the Department of Transport.
