Vol. 561 No. 6

Written Answers - Liquor Licensing Laws.

Tony Gregory

Question:

116 Mr. Gregory asked the Minister for Justice, Equality and Law Reform if the Garda Síochána have received complaints of serious anti-social behaviour and criminal activity emanating from licensed premises (details supplied) in Dublin 7 in the early hours; the reason this premises continues to obtain extensions for late night discos and drinking; if the Garda intend to object to such extensions; and if he will make a statement on the matter. [5067/03]

I am informed by the Garda authorities that three formal complaints have been received from local residents since the beginning of 2003 in relation to the licensed premises concerned. These complaints relate to excessive noise and litter.

Prior to these formal complaints gardaí were called to these premises on a number of occasions in relation to alleged assaults. When they arrived to investigate neither the people at the premises nor local residents were willing to make formal complaints or give their names and address.

The premises in question are inspected on a regular basis by local gardaí. It was found to be compliant with the licensing laws and any exemption orders granted on all occasions. Due to the compliance of the premises and the previous absence of formal complaints the local Garda management were left with little basis for objecting to the granting of exemption orders by the District Court.

Three formal complaints have been made in 2003. Consequently, local Garda management have undertaken to contact each complainant in order to request them to attend court to make known their complaints when the next application for an exemption order is before the District Court. The licensing laws will continue to be enforced by local gardaí.
