Question:

208 Mr. Naughten asked the Tánaiste and Minister for Enterprise, Trade and Employment the secondary legislation outstanding within her Department; the function of each piece of secondary legislation; and if she will make a statement on the matter. [5516/03]

The following is a list of outstanding pieces of secondary legislation coming within the ambit of my Department's responsibilities, together with a note on the function of each piece of legislation:

Title: Carriage of Dangerous Goods by Road (Regulations) 2002.

Function: to transpose Commission Directive 2001/7/EC of 29 January 2001 adapting for the third time to technical progress Council Directive 94/55/EC on the approximation of the laws of member states with regard to the transport of dangerous goods by road.

Title: European Communities (Classification, Packaging and Labelling of Dangerous Preparations) Regulations 2002.

Function: to transpose Directive 1999/45/EC of the European Parliament and of the Council of 31 May 1999 concerning the approximation of the laws, regulations and administrative provisions of the member states relating to the classification, packaging and labelling of dangerous preparations.

Title: European Communities (Classification, Packaging, Labelling and Notification of Dangerous Substances) Regulations 2002.

Function: to transpose Commission Directive 2001/58/EC of 27 July 2001 amending for the second time Directive 91/155/EEC defining and laying down the detailed arrangements for the system of specific information relating to dangerous preparations in implementation of Article 14 of European Parliament and Council Directive 1999/45/EC and relating to dangerous substances in implementation of Article 27 of Council Directive 67/548/EEC, safety data sheets.

Title: European Communities (Classification, Packaging, Labelling and Notification of Dangerous Substances) Regulations 2002.

Function: to transpose Commission Directive 2001/59/EC of 6 August 2001 adapting to technical progress for the 28th time Council Directive 67/548/EEC on the approximation of the laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances.

Title: European Communities (Classification, Packaging and Labelling of Dangerous Preparations) Regulations 2002.

Function: to transpose Commission Directive 2001/60/EC of 7 August 2001 adapting to technical progress Directive 1999/45/EC of the European Parliament and of the Council concerning the approximation of the laws, regulations and administrative provisions of the member states relating to the classification, packaging and labelling of dangerous preparations.

Title: European Communities (Dangerous Substances and Preparations) (Marketing and Use) Regulations 2002.

Function: to transpose Commission Directive 2002/62/EC of 9 July, 2002 adapting to technical progress for the ninth time Annex I to Council Directive 76/769/EEC on the approximation of the laws, regulations and administrative provisions of the member states relating to restrictions on the marketing and use of certain dangerous substances and preparations, organostannic compounds.
Title: European Communities (Dangerous Substances and Preparations) (Marketing and Use) (Aerosol Generators) Regulations 2003.
Function: to transpose Directive 94/48/EC of the European Parliament and of the Council of 7 December 1994 amending for the 13th time Directive 76/769/EEC on the approximation of the laws, regulations and administrative provisions of the member states relating to restrictions on the marketing and use of certain dangerous substances and preparations.
Title: European Communities (Dangerous Substances and Preparations) (Marketing and Use) Regulations 2002.
Function: to transpose Directive 2001/41/EC of the European Parliament and of the Council of 19 June 2001 amending for the twenty-first time Council Directive 76/769/EEC on the approximation of the laws, regulations and administrative provisions of the member states relating to restrictions on the marketing and use of certain dangerous substances and preparations, as regards substances classified as carcinogens, mutagens or substances toxic to reproduction.
Title: European Communities (Directive 2000/31/EC) Regulations 2002.
Function: To transpose those provisions of Directive 2000/31/EC which were not transposed by the Electronic Commerce Act 2000 into Irish law.
Title: Transfer of Undertakings (Amending) Directive (Council Directive 98/50/EC).
Function: European Council Directive 98/50/EC amends Directive 77/187/EEC on the approximation of the laws of the member states relating to the safeguarding of employees rights in the event of transfers of undertakings, businesses or parts of businesses.
Title: 2001/29/EC: Harmonisation of certain aspects of copyright and related rights in the information society.
Function: The primary purpose of this Directive is to bring EU copyright law into line with new international law obligations undertaken by the EU under the World Intellectual Property Organisation, WIPO, Copyright Treaty and the WIPO Performances and Phonograms Treaty, both of which were signed at Geneva on 20 December 1996. It should be noted that the majority of the provisions of this directive have already been transposed into Irish law by the Copyright and Related Rights Act 2000. However, in order to fully transpose this directive into Irish law, secondary legislation will be necessary.
Title: European Communities (Labelling, Presentation and Advertising of Foodstuffs) Regulations 2002.
Function: This amending directive relates to the labelling, presentation and advertising of foodstuffs and provides for a new category called meat and the name of the species from which it derives.
It has been agreed that responsibility for this policy area should be transferred to the Department of Health and Children.
With regard to Directives 1999/63/EC – Council Decision of 21 June 1999, which provides for the regulation of working time of seafarers – and 1999/95/EC, Council Decision of 13 December 1999 which provides for the verification and enforcement of compliance by ships calling at ports of member states with Directive 1999/63/EC, discussions are ongoing between officials of my Department and the Department of Communications, Marine and Natural Resources on the appropriate form of transposition of both directives.
