Question:

427 Mr. Carey asked the Minister for Justice, Equality and Law Reform if his Department, through its prison policy division, has had an opportunity of examining the case of a person (details supplied) in England who wishes to be considered for repatriation to an Irish prison. [5214/03]

I can confirm that my Department has received the formal application for transfer from the United Kingdom authorities of the person referred to in the Deputy's question.

The application is currently being considered by the State's legal officers to ensure that the requirements of the Council of Europe Convention on the Transfer of Sentenced Persons and the Transfer of Sentenced Persons Acts 1995 and 1997 are satisfied. I will make my decision in this case on receipt of their advices.
