Question:

445 Mr. Costello asked the Minister for Justice, Equality and Law Reform the number of cases in which citizens initiated charges against the Garda for assault in each of the past five years; the number of such cases that had counter-charges made by the Garda defendants; the number of cases that were later discounted by the citizen initiating the case; the number that were discounted by the Garda; and the number that were settled out of court. [5621/03]

The information requested by the Deputy in relation to the number of cases in which citizens initiated civil proceedings against the Garda for assault is set out in tabular form as follows. The details given cover five years from 1998 to 2002.

The other information is not readily available in the format sought by the Deputy covering the five year period in question. I am having inquiries made to establish to what extent it can be provided and I will communicate with the Deputy as soon as possible.
