Written Answers - Asylum Applications.

Question:

390 Mr. Naughten asked the Minister for Justice, Equality and Law Reform the status of an application for asylum by persons (details supplied); when a decision will be made by his Department; and if he will make a statement on the matter. [6248/03]

The persons concerned are a husband and wife from Moldova and two children, one of whom was born in Ireland in July 2002. They claimed asylum when they entered the State in December 2000. The husband's case is still with the Refugee Appeals Tribunal, which is an independent body. The wife has applied for residency in the State, on the basis of being the parent of an Irish-born child. This application, along with other outstanding applications which were made on the same basis, will be decided in due course having regard to the Supreme Court decision of 23 January 2003 in relation to the residency rights of non-national parents of Irish-born children.
