134 Mr. Gormley asked the Tánaiste and Minister for Enterprise, Trade and Employment when the Personal Injuries Assessment Board may be able to be extended to public liability and all employer's liability claims as recommended by the National Competitiveness Council report in November 2002; her views on whether a book of quantum should be developed for application to claims within the court system and the PIAB; and when such a system can be introduced. The report of the interdepartmental implementation group set up to progress the establishment of the Personal Injuries Assessment Board, PIAB, endorsed a recommendation contained in an earlier report on personal injury compensation that the board should be charged with assessing claims arising from employers' liability in a first phase. After a review, the PIAB would then assess claims arising from motor accidents, in a second phase. The intention therefore is that the PIAB will commence with the assessment of employers liability personal injury claims and that it will implement a robust method of monitoring its success on an ongoing basis, before its brief is extended to the assessment of other types of claims.

The PIAB will make its assessments on the basis of precedents set by the courts. This will necessitate the establishment of a database based on court awards. The Courts Service has put arrangements in place to compile a database of damages awards and of settlements ruled by the courts in personal injuries cases. The interim PIAB has commenced work on the compilation of a database, on which its assessments will be based, making use of the information compiled by the Courts Service.
