Question:

213 Mr. R. Bruton asked the Minister for Transport if he has received a request regarding the need for a legal authority to impose a ban on HGVs using designated residential roads at night time from Dublin City Council; and if he will make arrangements for the introduction of the necessary orders or regulations. [9409/03]

The position in relation to the application of restrictions on heavy goods vehicles entering public roads is established through the Road Traffic (Traffic and Parking) Regulations, 1997 (S.I. No. 182 of 1997). Article 17 of these regulations provides that where the appropriate traffic sign is provided at the entrance to a road, the driver of a vehicle, the unladen weight of which exceeds the weight specified on the sign, is prohibited from proceeding beyond the sign except where it is necessary for the vehicle to enter a road solely for the purpose of gaining access to or egress from premises accessible only from that road. The application of such restrictions is a matter for each local authority.

The application of that restriction is not limited to particular periods of the day. However, a request to introduce such a time based provision has recently been received by my Department from Dublin City Council and is being considered.
