Written Answers - Asylum Applications.

Question:

215 Mr. Gormley asked the Minister for Justice, Equality and Law Reform if he has received an application for compassionate leave to remain from a person (details supplied); and if a decision has been reached on this person's application. [9268/03]

The person concerned arrived in the State on 27 May 2001 and sought asylum. She failed to attend for interview on two occasions in December 2001 and January 2002 and her application for refugee status was subsequently refused. The applicant was informed by letter of 29 September 2002 that the Minister proposed to make a deportation order in respect of her. A person served with such a notice of intent is afforded three options – to leave the State voluntarily, to consent to the deportation order or to make representations in writing within 15 working days of the sending to him or her of the notice of intent. She did not avail of any of the options and failed to reply to the correspondence.

The applicant's case was examined under section 3 of the Immigration Act 1999 and section 5 of the Refugee Act 1996 (Prohibition of Refoulement). A deportation order was signed in respect of her on 30 October 2002. She was informed of this decision by letter of 29 November 2002. In the meantime, representations have been made in respect of this person which will require a further assessment of her case. This will take place as soon as possible and the person concerned will be informed of the outcome.
