Question:

69 Mr. Cuffe asked the Minister for Agriculture and Food the biocide register required under EU legislation; and the prosecutions that ensued following the illegality of using or selling unregistered pesticides since 1 January 2003. [9219/03]

There is no requirement under EU legis lation to establish a register of the biocidal products sold in Ireland. Biocides are being regulated for the first time in Ireland under EU Directive 98/8 as transposed by S.I. No. 625 of 2001, so there is limited information with respect to the range and number of biocidal products sold in Ireland. As a transitional measure and with a view to determining the number of biocidal products sold in this country my Department decided to oblige companies, marketing biocidal products, to notify this information to the pesticide control service for the purpose of establishing such a register. This register will be established in early 2004. There have been no prosecutions by my Department for the illegal sale or use of pesticides-biocides since the 1 January 2003.
