Question:

60 Mr. N. O'Keeffe asked the Minister for Agriculture and Food if he will permit the transfer of a milk quota from a person (details supplied) in County Cork to their brother in law. [11259/03]

The provisions governing the transfer of milk quotas are laid down in the European Communities (Milk Quota) Regulations 2000, as amended. With certain exceptions, a milk quota may transfer only where the land to which it attaches is also transferred. While the regulations do provide for the transfer of a quota to a relative where the land in question is also transferring by sale, lease, gift or inheritance, the definition of "relative" set down in the regulations does not extend as far as brothers-in-law.
