188 Mr. Penrose asked the Minister for Agriculture and Food the reason a penalty has been applied in the case of special beef premium for a person (details supplied) in County Westmeath; and if he will make a statement on the matter. [11571/03]

The person named submitted an application for EU special beef premium on 5 December 2002 in respect of four bulls. The applicant was informed that the first day on which these animals could be sold was 6 February 2003. However, during processing it was noted that two of the four animals were slaughtered during the retention period, on 16 December 2002. In accordance with the regulations governing the bovine schemes, no special beef premium is payable in respect of the two animals and a reduction penalty will be applied in respect of the remaining eligible bovine scheme animals qualifying for payment in 2002. Advance payments of special beef premium and slaughter premium have issued to the person named. Moneys overpaid will be recouped from future payments.

The person named has been informed of his right to a review of this decision.
