Written Answers. - Milk Quota.

Question:

206 Mr. Stanton asked the Minister for Agriculture and Food if he will consider making extra milk quota available to a person (details supplied) in County Cork; and if he will make a statement on the matter. [12003/03]

Allocations of milk quota from the national reserve are granted on the basis of recommendations from the milk quota appeals tribunal. The tribunal is a body established to consider and advise on applications for additional quota from individual producers who have suffered severe hardship in the context of the milk quota system. My Department did not receive an application on the grounds of hardship from the person named in 2002. He may, however, apply to the tribunal in the 2003-04 milk quota year when the application forms become available. The forms will be available in the autumn from his co-operative-dairy or from the milk policy division of my Department.

The person named did, however, apply for additional milk quota under the recent scheme for the allocation of 32 million litres of milk quota to committed small and medium scale milk producers who satisfied certain criteria as set out in public notice No. 94/15. However, as the conditions of the scheme were not satisfied, an allocation was not made.

An appeals procedure was introduced in relation to this scheme whereby applicants who did not qualify under the conditions of the scheme or who feel that the allocation made in their particular case was incorrect, could appeal the decision to the milk quota appeals tribunal. The closing date for receipt of such appeals was 10 January 2003. There is no record of the person named having submitted an appeal before the closing date.

207 Mr. Kehoe asked the Minister for Agriculture and Food if a person (details supplied) in County Wexford will be allocated additional milk quota following the submission of the latest information regarding the farm plan; and if he will make a statement on the matter. [12073/03]

The allocation of the balance of the Agenda 2000 milk quota to certain categories of small and medium scale milk producers has been completed and applicants have been notified of the outcome in their own cases. An application was submitted by the person named in relation to this quota. However, as the conditions of the scheme were not satisfied, an allocation was not made.

An appeals procedure exists in relation to this scheme and the person named has submitted an appeal. The assessment of appeals will be based on recommendations from the milk quota appeals tribunal. Work on the assessment of the approximately 1,800 appeals arising from the scheme is expected to be completed shortly and at that stage each appellant will be notified of the outcome.
