Written Answers. - Nursing Home Subventions.

Question:

444 Ms O. Mitchell asked the Minister for Health and Children the result of his investigation into the EU tribunal ruling in respect of state subventions to public nursing homes in Britain, vis-à-vis their impact on private homes; the action he is considering to avoid a similar unfair trading ruling being applied here, as promised in his reply to Question No. 346 of 12 November 2002; and if he will make a statement on the matter. [11676/03]

While my Department is aware that the British Competition Commission Appeal Tribunal in 2002 dealt with a case in the area of state funding to public nursing homes, and that a couple of cases in related areas have come before the Court of Justice of the European Communities, it is not aware of any cases that have a direct bearing on the system of nursing home subvention applied in this country. If the Deputy has a specific case in mind, I would be most anxious to know about it and to have it investigated by my officials.
