Vol. 566 No. 1

Written Answers. - Charitable Trusts.

Brian O'Shea

Question:

747 Mr. O'Shea asked the Minister for Community, Rural and Gaeltacht Affairs his proposals to ensure that where the Commissioners for Charitable Donations and Bequests consent to the sale or disposal of lands and property held or owned by charitable trusts, they retain copies of the trust deed; and if he will make a statement on the matter. [11497/03]

As regards the specific issue raised by the Deputy, I understand that the procedure followed at present by the Commissioners for Charitable Donations and Bequests, when an application is made to them, is to ask for documentary evidence of a trust attaching to a particular property. The commissioners' office does not feel it necessary to keep copies of trust documents after it has been checked out satisfactorily that the trust described in the original deeds is as set out in the application. I further understand that this procedure has not given rise to any difficulty.
