197 Mr. P. Breen asked the Minister for Agriculture and Food the breakdown for each county in the allocation of milk quota under the 32 million litre scheme; and if he will make a statement on the matter. [14614/03]

Question:

198 Mr. P. Breen asked the Minister for Agriculture and Food when a person (details supplied) in County Clare was notified of the qualification of the 32 million litre scheme; the reason the person did not satisfy the conditions of the scheme; when they were informed that they did not qualify for the scheme; when this person's co-op was informed that they did not qualify for same; and if he will make a statement on the matter. [14615/03]

The person in question failed to qualify for an allocation of quota under the 32 million litre scheme as his milk deliveries in one of the reference years was not greater than the actual quota allocated in 1984 or increased by any subsequent allocation from the national reserve. Due to an error within my Department, a letter issued to the person in November 2002 erroneously noti fying him that he qualified. When this error was discovered, the applicant was informed by letter on 2 December of his failure to satisfy the condition. This correcting letter, however, based on inaccurate information from his co-operative, stated that the failure was due to quota having been temporary leased during the period 1998-99 to 2000-01 rather than the actual reason referred to above. While errors in communicating the outcome of this application are regretted, the fact is that the applicant failed to qualify on the basis of one of the primary criteria. A definitive listing of allocations issued to the co-operative concerned in March 2003.

The allocation of milk quota from the national reserve is granted on the basis of recommendations from the milk quota appeals tribunal. The tribunal is a body established to consider and advise on applications for additional quota from individual producers who have suffered severe hardship in the context of the milk quota system. The person named may apply to the tribunal when the application forms become available in the autumn from his milk purchaser or from the milk policy division of my Department.
