Written Answers. - Social Welfare Benefits.

Question:

261 Mr. Durkan asked the Minister for Social and Family Affairs the reason a person (details supplied) in County Kildare has not been awarded unemployment or disability benefit from the date of loss of employment; and if she will make a statement on the matter. [15142/03]

The person concerned claimed unemployment assistance on 16 April 2003. Following an examination of his case his claim was disallowed, in accordance with section 125 (5)(a) of the Social Welfare (Consolidation) Act, for a period of nine weeks, on the grounds that he lost his employment through his own misconduct.

Notification of the decision and his right to appeal issued on 21 May 2003. The person concerned has been paid supplementary welfare allowance from 30 April 2003 to 28 May 2003. The person concerned did not apply for nor does he have an entitlement to disability benefit. Under social welfare legislation decisions in relation to claims must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
