172 Mr. Timmins asked the Minister for Agriculture and Food the position in the case of a person (details supplied) in County Wicklow; if this quota can be allocated under hardship grounds; when there will be a decision on this; and if he will make a statement on the matter. [18117/03]

The allocation of the balance of the Agenda 2000 milk quota to certain categories of small and medium scale milk producers has been completed and applicants have been notified of the outcome in their own cases. An application was submitted by the person named in relation to this quota. However, as the conditions of the scheme were not satisfied, an allocation was not made.

An appeal was subsequently lodged for this applicant, but based on the evidence provided, he did not satisfy the conditions of the scheme, and no allocation was made. The result of this appeal was issued to the appellant on 20 June 2003.

The Milk Quota Appeals Tribunal is a body established to consider and advise on applications for additional quota from individual producers who have suffered severe hardship in the context of the milk quota system. The person named may apply to the tribunal when the application forms become available in the autumn from his milk purchaser or from the milk policy division of my Department.
