151 Mr. Timmins asked the Minister for Agriculture and Food the position in relation to the case of a person (details supplied) in County Kildare; when this deal will go through; and if he will make a statement on the matter. [19071/03]

This case relates to the conditions attached to the sale of milk quota into the restructuring scheme. This scheme is operated at co-operative level and therefore the matters arising are, in the first instance, for the co-operative. While the circumstances of the case are difficult, I cannot see how quota can be sold into the scheme until the matter of the charge on the land in question has been resolved. My Department has responded to the legal representatives of the named person along these lines. To allow additional time for the problem to be resolved, my Department has requested the co-operative to extend the time within which milk may be sold into the restructuring scheme.
