1151 Mr. Gilmore asked the Minister for Justice, Equality and Law Reform if he has con sidered the judgment in a case (details supplied) in the European Court of Human Rights; the implications the judgment has for Irish legislation; his plans to introduce legislative measures arising from the case; and if he will make a statement on the matter. 1243 Mr. Cuffe asked the Minister for Justice, Equality and Law Reform his views on the recent European Court of Human Rights decision (details supplied) in which the appellant claimed that the length of the proceedings constituted a breach of their right to a fair hearing within reasonable time and to an effective remedy; the measures he intends to take to remedy this difficulty here; and when he proposes to initiate these changes. I propose to take Questions Nos. 1151 and 1243 together.

The implications arising from a number of recent judgments of the European Court of Human Rights in relation to judicial delays – including the case referred to by the Deputies – are currently being considered by my Department. In relation to delays in court proceedings generally, I should add that section 46 of the Courts and Court Officers Act, 2002, provides for a register of reserved judgments. The appropriate commencement date for this section is under consideration.
