Question:

1204 Mr. Wall asked the Minister for Justice, Equality and Law Reform if the visa application of a person (details supplied) in County Carlow will be reassessed on the evidence provided; and if he will make a statement on the matter. [20625/03]

The person to whom this question refers entered the State in December 2002 and registered as a student on foot of false docu mentation. When this falsehood came to light, the person was informed on 1 September 2003, in accordance with section 3 of the Immigration Act 1999, that it was proposed to make a deportation order in respect of him and was given the following options: to make written representations within 15 working days to the Minister for Justice, Equality and Law Reform setting out reasons he should be allowed to remain in the State; to voluntarily leave the State or to consent to deportation.

The person responded by letter dated 22 September 2003 to the effect that he had been issued with a work permit by the Department of Enterprise, Trade and Employment in August 2003. Notwithstanding the issue of such a permit, I will shortly decide on the issue of this person's deportation taking full account of the requirement to uphold the integrity of the immigration system in this State.
