102 Mr. N. O'Keeffe asked the Minister for Agriculture and Food the reason for the delay in his Department agreeing to a person (details supplied) in County Cork transferring their milk quota from one creamery to another. [21733/03]

There is no delay in my Department in dealing with this case. The current rules relating to transfer are that if a person wishes to transfer deliveries from his or her existing milk purchaser to a new purchaser he or she must formally notify both purchasers of the intention to transfer. Deliveries to the new purchaser may begin only from the start of the second quarter after the date of notification.

When deliveries to the new purchaser have commenced, that purchaser has a period of two months to apply to the Minister for an appropriate adjustment to its overall milk quota to take account of the new quota being transferred. To date no such application has been received in this case, and hence the issue of a delay does not arise.
