472 Mr. G. Mitchell asked the Minister for Justice, Equality and Law Reform when he will reply to a letter making representations on behalf of a person (details supplied) in Dublin 8; and if he will make a statement on the matter. [21835/03]

A reply to the Deputy's rep resentations on behalf of the person in question issued on 22 September 2003. The representations were in respect of a non-EEA national who wished to visit her husband in the State, along with her two children. The visa application in question was refused in December 2002 due to insufficient supporting documentation. The applicant stated on her visa application form that her husband was in the State, however no documentation was submitted to show the basis on which her husband is resident in the State.

The time limit on appealing the visa refusal is long past. However, it is of course open to the person to make a fresh visa application. In this regard, any new application should be supported by up to date documentation which should include evidence of her husband's current residency status in the State and evidence that either the applicant or her spouse has sufficient funds to support her and her two children during the visit to the State. Full copies of both passports should also be submitted with the application.
