Question:

510 Mr. R. Bruton asked the Minister for the Environment Heritage and Local Government if his attention has been drawn to county councils recently entering into their development plan conditions restricting planning permission and other terms of access to local housing to those who are residents of their respective counties; and if such restrictions conform with the laws preventing unfair discrimination in access to housing. Sections 39 and 47 of the Planning and Development Act 2000 allow for the grant of planning permissions subject to conditions specifying that use as a dwelling shall be restricted to use by persons of a particular class or description.

In addition, local authorities may include more general objectives in their development plans relating to the use and occupation of new developments.

The application of these provisions in relation to any particular development plan or in relation to the grant of individual planning permissions is a matter for the relevant planning authority or for An Bord Pleanála in relation to a planning appeal.
