102 Ms McManus asked the Minister for Justice, Equality and Law Reform his views on the recent report of the European Committee on the Prevention of Torture and Inhuman or Degrading Treatment or Punishment, which expressed serious concern regarding the ill-treatment of some persons in Garda custody; the steps he is taking to address the issues raised in the report; and if he will make a statement on the matter. The Government's response to the report of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment, on its visit to Ireland from 20 May to 28 May 2002, which was made public by the committee on 18 September 2003, addresses fully the concerns raised by the committee, including their concerns regarding persons in Garda custody.

Central to this is the Government's commitment to establish an independent Garda inspectorate which will have the power to investigate complaints and which will also have the powers of an ombudsman. Legislative proposals in this regard have recently been published.
