Vol. 573 No. 3

Written Answers. - Tenant Evictions.

Arthur Morgan

Question:

665 Mr. Morgan asked the Minister for the Environment Heritage and Local Government the number of persons evicted in each of the past six years; and if he will make a statement on the matter. [25050/03]

I assume that the question relates to rented residential accommodation. At present, tenancies in the private rented sector are subject to the landlord and tenant code, which is the responsibility of the Minister for Justice, Equality and Law Reform. Statistics on evictions, whether legal or otherwise, are not available to it.

The Residential Tenancies Bill 2003 is currently before the House. It provides for significantly improved security of tenure in the private rented sector while respecting the rights of accommodation providers to regain possession where there are valid grounds for this. The Bill also provides for an effective means of redress through a statutory private residential tenancies board in the event of illegal evictions. The board will compile data on such cases brought to it as well as on its determinations in other cases referred to it relating to the validity of tenancy terminations.

With regard to local authority housing, the number of District Court warrants enforced for the recovery of possession under section 62 of the Housing Act 1966 is as follows:

1999

2000

2001

2002

141

126

115

79

Information for previous years and on the number of persons involved in the above cases, as distinct from the numbers of houses repossessed, is not available.
