Question:

164 Mr. Cuffe asked the Minister for Foreign Affairs if the Constitution will take precedence over the proposed EU Constitution regarding right to life issues. [27760/03]

Ireland's Protocol to the Maastricht treaty makes clear that nothing in the current treaties "shall affect the application in Ireland of Article 40.3.3 of the Constitution of Ireland", putting beyond any doubt the precedence of our Constitution on right to life issues. The Government is working to ensure that the substance of this protocol, and of the related solemn declaration, is carried forward unchanged into the new constitutional treaty.
