Question:

199 Mr. Cuffe asked the Minister for Justice, Equality and Law Reform the number of asylum seekers currently seeking leave to remain here, following refusal at both first instance and appeal. [27874/03]

Under section 3(6) of the Immigration Act 1999, as amended, the Minister, in determining whether to make a deportation order has regard to 11 specified considerations, one of which is a representation made by or on behalf of the person. A final decision on deportation is not dependent on whether the person has made representations for leave to remain. A person refused refugee status in the State is but one of nine categories of persons whom the Minister can make a deportation order against or grant temporary leave to remain.

Separate statistics on the making of deportation orders or granting leave to remain are not maintained to distinguish between the nine categories of persons. Separate statistics are not maintained to distinguish between cases where representations have been made for leave to remain from those where no representations were made.
